Probably.

$2k or higher though... as Tim mentions, Small Claims Court.

Which probably results in you being listed alongside other people who'll need to be paid off in case the company goes bankrupt.

Justin probably can talk more wisely about this than I can; he's like a lawyer 'n stuff. I'm just a layman with an opinion and anec-data here, and I could be totally wrong.
